Not
long after Connie Scott hung up the phone there was a pounding
on the Scott's door. Before Carl Scott could answer the
door, it was knocked in by John Doe. During the illegal
entry into the home Carl Scott was hit in the eye and Jane
across the face by the swinging door. Several people, including
Kathy and John Tull, plus 16 year old John and his friends
and several members of the Tull family were gathering around
screaming and yelling. At come point they pulled Jane Doe
out of her house and began hitting Carl. Connie Scott called
the police, which in the end would do more harm than good.
When
police arrived, 16 year old John Doe struck Officer Joseph
Lager and was arrested. Kathy Tull assaulted Connie Scott
by kicking her several times in her stomach, for which
she was not arrested. Two of the officers present actually
asked Jane whether she had made an appointment with an
abortion clinic to which she responded yes.
Officer
Darrell Howard arrived at the scene in his own car at which
point he tried to give Jane anti-abortion literature in
a manila envelope. It was learned later that Officer Howard
had been at the Tulls house earlier that afternoon discussing
ways to prevent Jane from having the abortion.
After
this disturbance, the Scott's went to stay at a cousins
house for the night. They had informed police as to their
plans and the location where they would be.
That
same day, Kathy Tull went to a local doctor, Dr. Bagby,
a doctor that I remember well, as I was treated at the
Blair Medical Clinic since I was a child. The name of the
clinic has since changed to Blair Medical Group, not much
of a difference and I can see that nothing else about this "group" has
changed either. Dr. K.C. Bagby and PA James Jordon cooperated
with Kathy Tull by giving her a letter stating that "any
elective abortion could potentially cause medical and emotional
damage to the mother at any stage in pregnancy" and
that an abortion at 23 weeks "could be harmful" to
the mother. This letter did NOT state that abortion at
this stage is not only legal, but safer than it was to
give birth. Kathy Tull then took the letter to the Blair
Police Department.
At
12:30 a.m. on Thursday September 28th, 1994, the Scotts
were awakened by police at their cousins house. More than
ten police cars were present with several police officers.
Blair is a small town, evidently they felt they needed
the entire force to take one girl into custody illegally.
The officers who arrived at the scene were Joseph Lager,
Nicholas Thallas, Bernd Schedrer as well as county officers
James Deemer, Richard Hillman and Julie Emswiler.
The
police took the minor Jane Doe into custody for the sole
purpose of preventing her from having an abortion. Police
told the Scott's that Jane was being taken into protective
custody, but offered no further information. The only thing
they did manage to do was steal their child in the middle
of the night, present to them the letter the Tull's had
illegally obtained from Dr. Bagby and PA Jordon and to
tell them that John E. Sampson, the County Attorney, had
directed them to take Jane Doe into custody. The Scott's
were also told that a hearing would be held the next morning
at 9:00 a.m. and they were advised to get an attorney.
They were not told where their daughter was being taken
or what they intended to do with her. |
