In October of 2008, Andrew Giese pled guilty to second degree assault charges and was sentenced to nine years in prison. In exchange, Andrew Giese agreed to testify against both his father (Kurt Giese) and his brother (Nathaniel Giese).  This “plea agreement” never should have taken place. I realize that 80% of cases are pled out, but this one shouldn’t have been.  Andrew was an active participant in the assault, the felonious restraint, and the murder of Travis Walker. The police reports show that Andrew beat not only Travis Walker with an aluminum baseball bat, but also beat Robert Brummitt under the watchful eye of their father.  


….As for the rest of the family? Nathaniel’s entered a guilty plea in March of 2009. He admitted guilt to voluntary manslaughter and armed criminal action. So what will young Nathaniel have to serve?  He was sentenced to twelve and three years to run consecutively.

Yes, I’m going to rant again. TWELVE AND THREE YEARS? Of course that means that he’ll be out in probably seven with good behavior it could even be sooner. What was that judge thinking?? What was the state thinking when they accepted his guilty plea to voluntary manslaughter? I’m so thankful that I don’t live in that county because I would have protested at the court house steps every single day!
On to Kurt Giese, the father. Kurt was convicted of second degree assault and armed criminal action. He’ll be sentenced sometime next month. We’ll post it here and soon as we get the news. For now, the jury recommended that Kurt Giese be sentenced to four and ten years.

This entire case was handled ineffectively from the beginning. From start to finish the case was bungled. That or just because Travis hadn’t been a mayor’s son or a sheriff’s daughter, the case didn’t deserve as much as if he’d of actually been and not just Travis Walker.

 

These three men took the life of a good kid, Travis Walker hadn’t been rich, and he hadn’t been someone important’s kid, he’d been goofy smiling, fun loving, Travis Walker and now he’s gone. What did the three men that kill him get? What sentences did they receive? One got nine years (he’ll be out in four and a half), one got fifteen years (he’ll be out in seven and a half, maybe sooner with good behavior) and get this – he’s the one that actually pulled the trigger! The actual murderer will only end up serving probably seven years while Travis Walker lies six feet under. The last participant in this fiasco is Kurt Giese himself who hasn’t actually been sentenced yet, but the jury’s recommendation was four and ten so that’s probably what he’ll get.

This case was a mockery from start to finish – those three men for all intensive purposes, literally got away with the murder of a nineteen year old young man as well as getting away with the assault on the other kids. What these sentences say to the public is this – hey folks, y’all can kill anyone you want to if you’re willing to serve a year or two in prison.
